Rest Romania provides its online "Gallery Albums" (albums in the gallery containing photo items) as a free service to allow the travel community to share travel photos. We want to make sure everyone using the photo gallery respects the law, Rest Romania and other users - which is the reason for these terms.

You should read these terms of use carefully before use as by using the Gallery Albums you are accepting them as an agreement between you and us (Rest Romania SRL), whether you are registered or simply browsing. We may change these terms of use from time to time, so check them regularly. We may contact you to inform you of these changes but are not required to.

Your photo on Rest Romania's Gallery makes it easy for you to post photos and lets other tourist see how great Romania is from the photos you post in your album. Not all types of photos are suitable for use on Rest Romania's Gallery. Here are the guidelines:

1. Submitted photos should be of high-quality, clear and current. You may be creative with your photos as long as it does not violate this policy.
2. Please do not upload photos of children alone, or images of yourself as a child. Photos containing only animals are not appropriate, but you may use photos of yourself together with pets.
3. Rest Romania's Gallery is not able to investigate or confirm the copyright or ownership of artwork or other uploaded images, so please do not upload files that do not contain photos of yourself. Any photo containing k, comics, celebrities, nudity, pornography, sexually explicit images or any copyrighted image (unless you own the copyright) is not permitted. Photos of celebrities and cartoon or comic images are generally copyrighted by the owner.
4. Submitted photos are limited to a size of 1MB and must be in one of the following formats: GIF, JPG, or PNG.
5. For security and privacy reasons, please do not upload any photos that contain contact information such as names, phone numbers, email addresses, or web site URLs.

If you see any photos on Rest Romania's Gallery that do not conform to this policy, please contact us or click on the Report Photo link and let us know.

Use of Gallery Albums:

First, you are only permitted to use the Gallery Albums for personal, non-commercial purposes, unless otherwise stipulated in an agent or operator agreement. 

If you are under the age of 18 you should seek your parents permission before accessing the Gallery Albums. Because users can automatically make photos, they may contain content which is not appropriate for people under 18. (Find tips on facilitating a safe internet experience for children on the Australian Broadcasting Authority's "CyberSmart Kids" site at www.cybersmartkids.com.au// )

Adding Your Photos:

If you wish to contribute photos and content such as themes and user profiles, you must register. Once you register on one Rest Romania Gallery, you are eligible to make your own album(s).

Although we don't monitor every single photo, we do drop in to see what's going on. We can (and sometimes do) remove photos that breach the intent or spirit of these terms of use without notice. We may also ban users who breach these terms of use, and delete their photos.  While the administrators and moderators of this Gallery will attempt to remove or edit any generally objectionable material as quickly as possible, it is impossible to review every album and every photo. Therefore you acknowledge that the photos made and posted to these Gallery Albums express the values, ideas about what is good photography, and portray the artistry of the author and not the administrators, moderators or webmaster (except for albums and photos by these people) and hence will not be held liable.

Don't make photos that contain racist, sexist or homophobic themes; harass or "stalk" any person; contain defamatory statements or portray personal attacks on others; disrupt users' enjoyment of the Gallery Albums (for example persistent off-album photos posted on Rest Romania Gallery Albums); personal details or private information about any other person (or anything contrary to our privacy policy); are made under another person's name or impersonating another person;  contain commercial advertising; contain excessively coarse language or content which would be rated R, RC or X by the Australian Classification Board (for more information please see the Office of Film and Literature Classification web site at http://www.oflc.gov.au); or breach any intellectual property rights law or discuss how to commit illegal activity.

In accord with the above, you agree not to post any abusive, obscene, vulgar, slanderous, hateful, threatening, sexually-oriented or any other material that may violate any applicable laws. Doing so may lead to you being immediately and permanently banned (and your service provider being informed).

The IP address of all posts is recorded to aid in enforcing these conditions. You agree that the webmaster, administrator and moderators of this Gallery have the right to remove, edit, move or close any album at any time should they see fit. As a user you agree to any information you have entered above being stored in a database. While this information will not be disclosed to any third party without your consent the webmaster, administrator and moderators cannot be held responsible for any hacking attempt that may lead to the data being compromised.

Make sure you use the right Rest Romania Gallery Album so you get the best response to your posts and to make it easier for those looking for information. We may move or delete photos posted to the wrong album.

Respect others' intellectual property rights! Don't post copyrighted material or trade marks without the permission of the owner or you may put yourself and Rest Romania at risk of legal action.

You can share a useful internet resource with other Rest Romania Gallery Albums users by hyperlinking to the relevant resource, but first make sure you're allowed to by checking the terms of use of the site you are linking to. Many site operators don't allow people to link to pages below the front page or home page of their site.

If you own intellectual property and believe it is being infringed through a photo, please contact us as soon as possible.

The copyright in your photos is yours (generally speaking). We sometimes use photos in our publications (books, newsletters, websites, television programs and other products in any media). You give us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide licence to reproduce, communicate, re-publish, edit, adapt or otherwise use your photos as we see fit, including the right to sublicense to others at our discretion. You also give us a licence to deal with the photos as necessary to perform technical and administrative functions in running the Gallery Albums.

You may also have moral rights, so you consent to your photos being altered, edited or adapted to use them under our licence in any way we see fit. You consent to us not attributing authorship to you at all, or only attributing it to your registered "handle". We generally attribute authorship, but that's not always possible and we decide this on a case by case basis. If we do use your material we may attribute it to your registered "handle", or contact you to request that your real name be used. Don't worry, we will never publish your real name without permission.

If you don't want your photos to be used in this way, don't post it. Once you have made a photo, you can't withdraw or retract the photo or your licence and consents.

Using photos:

If you want to copy, amend or re transmit others' photos, you need permission. Permission can be obtained from the user or from us as licensee. 

If you want to share photos with a friend please send them a hyperlink. Third party commercial sites are not permitted to use photos in any way, even through hyperlinks, without our permission (which we often give in exchange for a link back to our site).

Rest Romania's intellectual property (which includes Gallery content other than photos and the Rest Romania, Rest Rom, distinctive diamond "R" logo trade marks) may not be used in any way or for any purpose without our permission.

Your personal information:

By registering, submitting photos, or emailing us, you will be supplying us with "personal information". We collect this to administer and help you use the Gallery Albums, send you a password, contact you about photos, and keep in touch with you.

Your user name will be visible to other users, and when you register for Rest Romania Gallery Albums, you can chose whether your user profile and email address will be also be visible to other users. You can access and update your personal information in the "profile" section of Rest Romania Gallery Albums at any time.

Sleep easy, we won't sell your contact details to marketing companies for spamming! But we may disclose information about you to our website developers (some of whom work on contract to us) and to other companies in the Rest Romania family. Complaints:

We take copyright, trade mark, defamation and other laws seriously. If you think a photo is infringing these terms or anyone's legal rights, let us know immediately. We will investigate all complaints and take action if we think it's necessary, including removing the photo or banning the relevant user.

To let us know:

Rest Romania Gallery Albums: Contact the moderator of the relevant album to draw their attention to the photo.

Removal of photos is at our discretion, except if the content is illegal. If you're not happy with the moderator's response, you can ask them to refer the matter to the Gallery manager. If you're still not happy, you can follow the formal complaints procedure below. We may also require you to follow the formal procedure for certain matters (for example, if you claim content is infringing copyright or defamatory).

Your complaint needs to:

• Identify the photo in issue and provide us with a copy of the photo and the location (URL, or web address) of the photo.
• Identify the intellectual property or other right which is being infringed by the photo or the law which the photo breaches. Articulate your arguments about this as thoroughly as possible.
• Provide information so that we can easily contact you (including if possible your email address, your postal address and fax number).

We will assess your complaint's merit and will take whatever action we see fit. We will get in contact with you to explain our decision.

If you're still not happy you can make a complaint to the Australian Broadcasting Authority. (For more information see www.aba.gov.au/internet/overview/complaints.shtml). We will comply with any directions given by the ABA in relation to these complaints.

Finally:

Any legal issues arising will be dealt with under the laws of New South Wales, Australia, since that's where the Gallery Albums are administered, authored and controlled. Illegal activity under those laws will be a violation of these terms, but as the Gallery Albums are accessible worldwide you may run into trouble under the laws other jurisdictions too.   These Gallery terms are in addition to the general website terms at http://www.restromania.com/_legal/Terms.htm, which apply to all pages in the Rest Romania family of websites.

We are not responsible to you or anyone else for any loss, damage, liability, cost or expense suffered in connection with the use of a Rest Romania Gallery or any of its content. We make no warranties or representations about the Gallery Albums or their content and exclude, to the maximum extent permitted by law, any liability which may arise as a result of the use of the Gallery Albums or its content. We will never be liable for any indirect, incidental, special or consequential loss, or loss of business profits or revenue arising out of the use of the Gallery Albums.

You indemnify us and the other companies in the Rest Romania family against each claim, action, proceeding, judgment, damage, loss, expense or liability incurred or suffered by, or brought, made or recovered against us or the other companies in the Rest Romania group of companies (including but not limited to Rest România SRL in Australia and Rest Rom SRL in Romania, it's agents and contractors) in connection with any breach by you of these terms of use.

This Gallery system uses cookies to store information on your local computer. These cookies do not contain any of the information you have entered above; they serve only to improve your viewing pleasure. The e-mail address is used for confirming your registration details and password (and for sending new passwords should you forget your current one and other important e-mail from Rest Romania).
